S.I. No. 88/2018 – Sea-Fisheries (North Western Waters Landing Obligation) Regulations 2018

This instrument implements the Landing Obligation contained in Article 15 of the Common Fisheries Policy Regulation 1380/2013 in respect of Demersal Fisheries in North Western Waters and gives effect to Commission Delegated Regulation (EU) 2018/46 of 20 October 2017. These regulations cease to have effect on 31 December 2018.

S.I. No. 89/2018 – European Union (Common Fisheries Policy)(Point System) Regulations 2018

This instrument adopts the requirements of Article 92 of Council Regulation (EC) No. 1224/2009 of 20 November 2009 and Title VIl of Commission Implementing Regulation (EU) No. 404/2011 of 8 April 2011. In accordance with the regulations, this instrument establishes a point system, which will apply to the Licence Holder of a sea-fishing boat when a serious infringement of the Common Fisheries Policy is detected within the Exclusive Fishery Limits of the State or for an Irish vessel, wherever it may be. The Sea Fisheries Protection Authority is determined as the competent authority for the establishment of the system and the assignment of points. The Licensing Authority is the competent authority for the recording of points assigned to the licence of an Irish registered fishing vessel and for the transfer of those points.

This Statutory Instrument provides for the establishment of a Determination Panel comprised of 3 independent legal professionals nominated by the Attorney General to determine if on the balance of probabilities a serious infringement occurred. The instrument also establishes an independent Appeals Officer to review the decision of the Determination Panel on the request of the licence holder.

The accumulation of points for persistent serious infringements of the Common Fisheries Policy will lead to the suspension of a sea fishing boat licence for a period from 2 months to one year. In extreme cases persistent serious fisheries infringements could lead to the permanent withdrawal of a licence.

S.I. No. 96/2018 – Waste Management (Tyres and Waste Tyres) (Amendment) Regulations 2018

These Regulations amend the Waste Management (Tyres and Waste Tyres) Regulations 2017 in order to broaden the definition of a producer for the purposes of these Regulations and to bring tyres transacted as part of a contract for rubber into their remit.

S.I. No. 99/2018 – Sea-Fisheries (Quotas) Regulations 2018

These Regulations have the purpose of giving effect to the provisions of Council Regulation 2018/120 of 23 January 2018 fixing for 2018 the fishing opportunities for certain fish stocks and groups of fish stocks, applicable in Union waters and, for Union fishing vessels, in certain non-Union waters.

S.I. No. 112/2018 – Inland Fisheries Ireland Superannuation Scheme 2018

The purpose of these Regulations is to adopt the Rules set out in the Schedule to the Rules for Pre-existing Public Service Pension Scheme Members Regulations 2014 ( S.I. No. 582 of 2014 ) as a scheme for the granting of superannuation benefits to or in respect of members of the staff, including the Chief Executive, of Inland Fisheries Ireland who are not members of the Single Public Service Pension Scheme.

S.I. No. 137/2018 – European Union (Common Fisheries Policy) (Landing Obligation) (Amendment) Regulations 2018

These regulations amend the European Union (Common Fisheries Policy) (Landing Obligation) Regulations 2015 ( S.I. No. 83 of 2015 ) which refer to vessels engaged in small pelagic and large pelagic fisheries in relation to species caught in those fisheries which are subject to catch limits in the North West Waters (ICES Zones Vb, VIa, VIb, VII) on a gear by species basis.

S.I. No. 155/2018 – Sea-Fisheries (Community Control System) (Amendment) Regulations 2018

These Regulations provide for the designation of the Port of Ballycotton for landings of Hake greater than 2 tonnes in accordance with Article 9 of Council Regulation (EC) No 811/2004 of 21 April 2004 establishing measures for the recovery of the Northern Hake Stock.

These Regulations also provide for the removal of the Port of Rosslare from the list of designated ports as provided for in the Schedule. The Port of Rosslare is being removed because, although listed in the Schedule, it was never, and is not proposed to be, designated for any of the species referred to in the Schedule.

The effect of these Regulations is to increase the Minimum Conservation Reference Size for razor clam taken by Irish sea-fishing boats in the north Irish Sea to 125 mm
